KENYA — Attorney General Justin Muturi has raised objections over the transfer of the Kenyatta University Teaching Referral and Research Hospital (KUTRRH) to the Ministry of Health (MoH) as a parastatal, labeling it as irregular.
During his appearance before the Public Investments Committee, Muturi underscored his objections to the hospital’s transfer, emphasizing the necessity of reversing the legal notice that facilitated the handover, with a call for the hospital to be returned to Kenyatta University’s oversight.
The Attorney General’s primary contention revolved around the establishment of KUTRRH, asserting that it should have been established through an act of parliament rather than initiated through a legal notice, as it currently stands.
Kenyatta University, responsible for the hospital’s construction, had expressed staunch opposition to the transfer to MoH, citing valid concerns regarding potential restrictions on access to the facility by teachers and students.
Paul Wainaina, Vice Chancellor of Kenyatta University, revealed the grave challenges he confronted in July, highlighting the perilous nature of his situation. He disclosed that both the hospital and the associated land were subjects of ongoing investigations.
Prof. Wainaina expressed relief that the matter was now receiving attention, stating, “The problems I went through in July were intricately tied to these issues, and I found myself in a situation where my life was at risk.
“The fact that these matters related to the hospital and land are now under investigation is like music to my ears.”
Explaining his steadfast decision to resist surrendering the university land despite mounting pressure, Prof. Wainaina described the circumstances as exceedingly hazardous.
He shed light on the influential figures behind the decision and the precautions he had taken, including temporarily residing in a hotel.
He further mentioned receiving a phone call from an individual at Harambee House who was privy to his whereabouts.
Claims made by the committee concerning KUTRRH were challenged by Kenyatta University Chairperson Olive Mugenda in July 2023.
Following the health committee’s visit to the institution, a comprehensive report was compiled, featuring various suggested courses of action.
The Public Investments Committee now intends to collaborate closely with the Office of the Attorney General to execute the recommendations put forward by the health committee, thereby addressing the ongoing controversy surrounding KUTRRH’s transfer and ensuring clarity in its governance.
